Common Construction Law Issues to Keep an Eye Out For

Adams and Reese Meet David Toney Podcast

In a recent podcast with David Toney, we learned about the history of Adams and Reese and what trends they are noticing in the world of construction law. 

If you own or manage a construction company, the last thing you need is a legal dispute of any kind. It’s good to know about what kind of legal trouble you could get yourself into to prevent a dispute from occurring in the first place. In a recent podcast, we got to speak with David Toney, co-chair of Construction at Adams and Reese, about the common construction law issues they see at their law firm. 

David has decades of experience in the legal world and has been with Adams and Reese since 2008 on their construction law team. He has long been interested in the field of construction. So much so that before he went to law school he worked a summer laying concrete.  

Now, he works alongside Trent Cotney with the common goal of being one of the top construction law firms in the country. “The goal is to be number one and I think the two of us will get there together,” he says. “Our team is really multifaceted. I'm really proud of the way it's come together.”  

He also shared with us some common legal problems their team sees their clients facing. He says that he’s seeing subcontractors and suppliers facing a lot of issues regarding defect lawsuits. One tip he has for contractors is to make sure that their crews are well-trained as this will minimize the risk for defect lawsuits. 

“The companies that really take time and put care into training their folks, they're going to have less claims, they're going to have less incidents,” David says. “It's a proven stat, and we try to send folks to all the industry organizations and help where we can.”
