I just discovered today that another local company which was founded only a few years ago has stolen my copyrighted proposal form! The form is totally and completely original, created by yours truly and can not be found anywhere other than an occasional h/o mailbox! lol Which evidently they discovered one at said place some time ago. It is extremely long and detailed, not generic in any way, form or fashion. I had a h/o call my office the other day looking for the owner of this other company because he had called the wrong number due to the forms being identical other than the letterhead. They simply copied our form word for word, top to bottom, and deleted our company letter head and inserted theirs. I had mixed emotions about this when i discovered their estimate in a h/o's mailbox today. At first i was upset, then i laughed and was somewhat flattered that me, "JUST A ROOFER" had done a good enough job creating a proposal form that someone else would want to use it also. But in the end the upset part won out because i put a lot of time, expeirence and knowledge into this form. I have a lot of customers tell me this form is why they decided to hire my company, because of it being so detailed and the multiple options offered. My lawyer says we can sue if i want to but really im not out to get anyone or their money i just want the MOMO to come up with his own dayum papwerwork! What would you do?>>>
I talked to the owner of the other company today. He agreed to change his version of my form! lol We will see what happens. I'll wait a month or two then have a friend request an estimate from him that is if i don't stumble across one sooner! lol>>>
I see maintanance contracts they're all the same .Different manufacturers or contracts act like they're the ones who invented them.>>>
I've ran across numerous instances where a contractor has gotten access to my proposals and fashioned much of his wording after mine. But I have no copywrite and each proposal is an original document. So I consider it an unfortunate compliment.
In this case, I would pursue a cease and desist, at the very least.>>>
I guess my point is that if they had any money, they wouldn't be ripping off your intellectual property. In my experience scumbags that do that kind of stuff usually don't have anything.
Why don't you have your attorney send them a letter demanding that they cease and desist using your intellectual property.>>>
