The home owner says the folks he hired to fix the chimney leak and install a new cap told him they give up. I think maybe they should have given up before they got started.

If that cap is too short they should have put that metal on first. OR build a cap that fits??? WOW job security sure is entertaining, isn't it? B)

The guy couldn't meet me yesterday but since I was already in the area, I stopped by to look at it. He had stated it was dripping on the inside of the fireplace but the cap was new. I'm thinking the reason they put the frame ( which is a seperate piece ) around the outside of the chimney cap is because the bend down of the cap was too short and didn't cover over the siding properly. If so, it would still leak. I don't see any other reason for that frame. If I can ever get the guy to call me back, I'm gonna set an appointment with him, check the attic and take part of the frame off to see if the bend down is too short.
