Texas Ins law requires that O&P be paid by all ins companies even on a one trade job (roofing) - even on an ACV claim where the insured pockets the money and doesn't do the repairs. That doesn't mean the ins companies pay much attention to the law however. Twenty years of in depth insurance and investment industry experience tells me that O&P + code upgrades + new vents, flashings, drip edge, etc. are all figured into the insureds premiums (NOTE TO: STATE FARM) which are based upon future full demo and rebuild pricing (and not on Xactimate prices). The problem is that not enough contractors know how to deal with adjusters and in house claim reps who are more concerned about job security than they are about doing the right thing for the policy holders, and, too many contractors aren't willing to take the time to do the reaserch to educate themselves in the processes that would get those insurance companies to do the right thing.

I can't think of a time I ever got O&P on one single trade in Texas... Although, I seem to remember sending them a subcontractor bill for roofing and getting it maybe once or twice. Pretty difficult though.
In the long run, I realized that it makes sense to pick your battles for O&P because if you constantly fight for it, you burn a lot of bridges and make it harder to get when it actually IS warranted.
Not Texas, its each indvidual insurance company and they do as they please.
